Genaro claims that her doctor had prescribed her a three-day medical leave in 2021 to deal with the stress of the Wilde and Sudeikis’ messy split.
But when she told Sudeikis, the suit claims, he ‘fired her on the spot.’ She is now seeking back-pay, punitive damages and the costs of attorneys fees.
Genaro has previously told DailyMail.com how the Horrible Bosses star would text her about his concerns as Olivia Wilde started to see Harry Styles more often, before bringing Genaro on a trip to London.
But the former celebrity couple quickly hit back at Genaro’s claims, calling them ‘false and scurrilous.’
They repeated that assertion in a statement to DailyMail.com about Genaro’s lawsuit, saying: ‘As parents, it is incredibly upsetting to learn that a former nanny of our two young children would choose to make such false and scurrilous accusations about us publicly.
‘Her now 18-month long campaign of harassing us, as well as loved ones, close friends and colleagues, has reached its unfortunate apex. We will continue to focus on raising and protecting our children with the sincere hope that she will now choose to leave our family alone.’
Genaro’s lawsuit details how she allegedly got put in the middle of the celebrity couple’s divorce after ‘Wilde abruptly left the home where she lived with Sudeikis, her two kids and Plaintiff as [a] live-in nanny’ in November 2020.
‘Wilde’s sudden absence from the home had an adverse consequence on its emotional state, including Sudeikis leaning on the presence of Plaintiff for support,’ the suit claims.
‘Although this shared trauma created a bond between Plaintiff and Sudeikis, Plaintiff became increasingly anxious and stressed with Sudeikis’ tendency to seemingly require Plaintiff to stay up at night after the kids were put to bed to talk, whereas that dynamic did not occur before Wilde’s absence.
‘The subject matter of these late night conversations with Sudeikis naturally evolved into speaking about Wilde, which Plaintiff felt compelled to engage in despite creating extreme anxiety to her as she ostensibly felt she had to “pick sides” between the parents of the children she was ostensibly the primary caretaker [of.]’

Eventually, the suit says, Genaro reached out to Wilde to talk about the situation, which she said she thought went well.
‘Plaintiff felt a genuine sense of relief and comradery with Wilde, who reacted sympathetically from Plaintiff’s point of view — Plaintiff thought she got enough off her chest to be able to function without anxiety as the live-in nanny for Wilde’s and Sudeikis’ children, with Wilde as a reliable ear,’ it says.
But when she, Sudeikis and the children were traveling to the airport in December 2020 to catch a flight to London, Genaro alleges, Sudeikis informed her that Wilde told him about their entire conversation.
‘Plaintiff was stunned at the abrupt announcement, and her heart sank because of its significance —there was no peace when confiding in Wilde,’ the suit says.
It continues to allege that Sudeikis then asked her ‘”Do you trust me?” as part “gotcha,” part threat and part confirmation Plaintiff was on Sudeikis’ side.’
By January 2021, Genaro alleges she told Sudeikis ‘of her physical pain, anxiety and stress,’ and soon the group therapist they were all seeing referred her to a doctor for ‘physical pain, anxiety and stress.’
That doctor had apparently told Genaro she needed to stop working for the celebrity couple, and on February 1, 2021, Genaro allegedly told Sudeikis of the doctor’s recommendation.
She ‘immediately added a desire to stay on as long as possible, up to five months, so that a suitable nanny is found to help with the transition for the good of the kids,’ the suit says.
‘Sudeikis’ reaction to this verbal notice was tempered,’ it claims.
The very next day, Genaro saw the doctor again and told him she was having increased stress following the announcement, according to the suit.
Yikes: Wilde and Jason Sudeikis are being sued by their former nanny for wrongful termination. They are pictured together in 2013
‘The osteopath’s response to Plaintiff’s account of her physical and mental state that morning was to prescribe Plaintiff the reaction of “radio silence” from everyone — including Sudeikis — for three days,’ the suit claims.
‘In other words, Plaintiff needed a three-day medical leave of absence because of her mental health — aka a stress leave.
‘The osteopath relayed this restriction to the therapist who relayed them to Sudeikis.’
Within hours, the lawsuit says, Sudeikis demanded to speak with Genaro.
‘When Plaintiff responded she is under the osteopath’s orders to not speak with anyone because of her anxiety, Sudeikis terminated her on the spot and directed [ML Management] to get Plaintiff out of his house and into a hotel.’
Genaro then allegedly tried to reach out to Wilde ‘for support in an attempt for help to merely have her restrictions honored, to no avail.
‘Plaintiff is informed and believes, and therein alleges, her termination was because of her disability of anxiety/depression, and for seeking the reasonable accommodation of a three-day leave of absence for same,’ the lawsuit says.
It argues she ‘suffered and continues to suffer substantial losses of wages, salary, benefits and additional amounts of money.’
Genaro has previously made similar claims in exclusive interviews with DailyMail.com.
She said Wilde continued texting and sending voicemails to her estranged fiance through November and December 2020 — but stopped after she was photographed in January 2021 with Styles at a wedding in Montecito, California.
The former House star had apparently left Sudeikis drunkenly ranting ‘she left us’ to the children’s nanny after abruptly dumping him for the British pop star on November 8.
Still, Genaro said, Wilde would continue to return to the house in Silverlake, telling Sudeikis she loved him. Those cozy messages and visits continued up until December 29, when Sudeikis and Genaro flew to London.
Wilde then went public with her new boyfriend Styles five days later.
The nanny said she was floored by their debut as a couple, even though she had known about their romance and how broken-hearted Sudeikis was that Wilde was with someone else.
The nanny told DailyMail.com: ‘When I saw Olivia holding hands as a couple with Harry in the news [in January 2021], I was shocked as just a month before, when we were in LA, she was sending Jason messages saying she loved him.
‘Text messages and voicemails. He let me hear the voicemails and the text messages. Then Jason said, she was just here [at the house] and she was naked in the pool and then she slept with me naked in the bed.
‘She was sending him voice messages saying he was her everything. It was a lot of mixed messages.
‘It was how can this be that she was just in this relationship and now she’s holding hands with a different person in front of everyone a month later. That was pretty shocking.’
At the same time, Wilde, 38, was so smitten with Styles, 28, the nanny claimed she even gave her dog Gordon away within weeks of meeting the British singer so she wouldn’t be tied to taking care of it and would be free up more time to spend with him.

The nanny said she then arranged for the Golden Retriever to live with Wilde’s New York-based dog walker.
‘After [Wilde] left [at the start of November 2020], she came for a visit and said, “we have to find Gordon a new home”, nonchalantly. Jason doesn’t really care for animals and wanted him out of their home asap,’ she said.
‘Jason said Olivia only had the dog for appearances anyway. She rarely cared for Gordon or Paco, the dog she had before. It was myself and others who cared for the dogs.
‘I told Jason I knew somebody who loves Gordon and was willing to take him in so Jason said, “let’s get him out of here right away”.’
